DKI Jakarta’s Tight Large-Scale Social Distancing Extended until 11 October

Following on our article titled ‘Covid-19: Jakarta Returns Back to Large-Scale Social Distancing’ – the Government of Special Capital Region of Jakarta (Pemerintah Provinsi Daerah Khusus Ibu Kota Jakarta, Pemprov DKI Jakarta”) has announced its policy to extend the implementation of PSBB until 11 October to further suppress the Corona Virus Disease 2019 (“Covid-19”) transmission. The reason of this extension is based on the Handling of Corona Virus Disease 2019 Acceleration National Task Force (“Covid-19”) (Gugus Tugas Percepatan Penanganan Covid-19) monitoring and evaluation result, which stated that the Special Capital Region of Jakarta still has extreme potential that Covid-19 cases will continue to spike if PSBB is not extended.

PSBB will be extended for another 2 weeks, from 28 September 2020 until 11 October 2020 (“Second Phase PSBB”). In regards to this extension, however, Pemprov DKI Jakarta did not establish new regulation as the basis for the implementation of the Second Phase of PSBB. In fact, this extension still refers to the same regulation that enacted the “First Phase of PSBB” (PSBB Vol. 2 which is implemented from 14 September 2020 until 27 September 2020).1 Governor Decree 959/2020 has set forth dictum on the extension of PSBB Vol. 2 to anticipate an increase of Covid-19 cases during the First Phase of PSBB Vol. 2.

As the result, during this extension, the same restrictions and rules will be applied which still refers to Governor of DKI Jakarta Regulation No. 88 of 2020 on Amendment on Governor of DKI Jakarta Regulation No. 33 of 2020 on Implementation on Large-Scale Social Distancing in Regards to Handling Corona Virus Disease 2019 in Special Region Capital of Jakarta Province (“Governor Regulation 88/2020”). For the purpose of breaking the ‘chain’ of virus transmission, Pemprov DKI Jakarta has stipulated certain administrative sanctions which applies to individual, businessmen and operator/management/Person in Charge (“PIC”) of public infrastructure, as set forth under Governor of DKI Jakarta Regulation No. 79 of 2020 on Disciplinary and Enforcement of Health Protocol as Prevention and Handling of Corona Virus Disease 2019 (“Governor Regulation 79/2020”). The administrative sanctions imposed over the violation of protocol will vary throughout the party who violates the respective protocol. Moreover, it is also noteworthy that the sanction will also progressively be imposed if the party violated the health protocol for more than one time.
